UNITED ARAB EMIRATES:

Death penalty reinstated for Abu Dhabi road-rage attacker

1 of 2 brothers accused of killing a middle-aged man in a road-rage attack has
had his death sentence upheld by a second Appeals Court - and approved by the
Court of Cassation.

The Emirati siblings were accused of harassing the victim, also an Emirati, as
he drove to move out of their way.

They then blocked his way to force him to stop, bumping his car from the front.
As the brothers were waiting for the police the victim went to a nearby park to
use the toilet.

The killer followed him and demanded he not leave before police arrived.

He then pulled him by his ghutra to the ground and attacked him by sitting on
his chest. The victim grabbed his private area to get rid of him.

The killer then hit him on the head before his brother and others interfered to
end the fight.

Both men were taken to hospital. The victim appeared unhurt and walked
normally, while the defendant was injured and transferred by ambulance.

However, 90 minutes after arriving at the emergency room, the victim passed
away in the hospital due to injuries in the brain, liver and ribs.

Both brothers were charged with murder and were sent to trial at the Criminal
Court.

One was sentenced to death and the other was cleared. The Appeals Court then
changed the charge to beating that lead to death and the death sentence was
replaced by 5 years in prison and blood money.

Public prosecution, however, appealed and the Cassation Court agreed with the
original death sentence and returned the case to a 2nd Appeals Court.

The 2nd Appeals Court found him guilty of murder and again sentenced him to
death. The Court of Cassation approved the death sentence, making the decision
final.
