White, Reporter RE: Agenda and documents for 1-09-08 Meeting Attached are an agenda and documents for the 1-09-08 KCCRC meeting. The minutes of the 11-28-07 meeting were recently received. Corrections to the minutes must be made before they are distributed to the Commission. As soon as we have them in appropriate form we will post the minutes. A first draft of the Legistative Report will be discussed. Prof. Stacy has proposed a change in the format that would bring the drug crimes section to the initial part of the document. We will discuss Prof. Tom's suggestions and those that you may have during our 1-09-08 meeting. Attached to this e-mail are three documents attached to the Report as appendices--(1) a list of the 3R's Recodification Subcommittee members, (2) drug crimes as revised by the KCCRC, and (3) the drug crimes recommendations memo. The drug crimes recommendations memo will need revision if the Commission approves including it in the Report. However, we have not yet discussed all proposals in the memo. Attached are the revisions to the drug crimes statutes. The drug crimes, as revised, are in two formats. You will recall that we have had discussions about the format we should use for our proposed statutes. Specifically, we have discussed whether the severity level for the crime should be included in the same sentence or paragraph as the crime definition or in a separately numbered paragraph. The revised drug crimes are submitted in both formats with the hope that we can decide which format to use in our future work. Revised drug crimes format A is attached to the draft Report as Appendix B. Drug crimes format B is attached to this e-mail. We will have further discussion of the drug crimes recommendations memo. It is attached to the Report as Appendix C. Brett has prepared a memo concerning drug quantities as a factor in determining appropriate sentences for drug crimes. His memo is attached. I have attached the property crimes draft. If you have your copies from the last meeting you need not copy them again as no changes have been made.
