I am sorry to have missed your previous meetings. I had no knowledge of one and was out of state at an Association of Disciplinary Counsel meeting at the time of another. Thus, I cannot ascertain if my comments are repetitive. But I do observe some impetus to rely on the work of the model penal code.


I discovered the attached Law Review material containing some critical observations of this Model Code. I attach it to emphasize some concerns I have about our work. Our final work product should be easily understood by all, lay and legal observers alike. I also am aware this author's comments have been criticized by other scholars. But, I urge us to carefully consider the practical impact our work product is likely to have on those who actually work with a code in practice.
