<P><SPAN LANG="en-us"><FONT SIZE=2 FACE="Arial">Since many of our subscribers are also members of the American Association of Law Libraries (AALL), and therefore receive the monthly AALL publication, “Spectrum”, I thought I would point out a link to an historical article located in<B><I> HeinOnline</I></B><I></I> that was mentioned by AALL President Claire Germain (Spectrum, June 2006, p. 4, column 2) as a result of her attendance at the commemoration of the 70<SUP>th</SUP> anniversary of the first edition of the Federal Register.</FONT></SPAN></P>
<P><SPAN LANG="en-us"><FONT SIZE=2 FACE="Arial">At the commemoration, which was held at the Government Printing Office (GPO) in Washington, DC, Solicitor General Paul Clement noted that the Federal Register actually began as a result of an article written in Harvard Law Review by Erwin Griswold (See 48 Harv. L. Rev. 198 at<U></U></FONT><U><B> <FONT COLOR="#0000FF" SIZE=2 FACE="Arial"><<A HREF="http://heinonline.org/HOL/Page?handle=hein.journals/hlr48&collection=top30&id=254">http://heinonline.org/HOL/Page?handle=hein.journals/hlr48&collection=top30&id=254</A>></FONT></B></U><B><FONT SIZE=2 FACE="Arial"></FONT></B> <FONT SIZE=2 FACE="Arial">for the complete article). </FONT></SPAN></P>
<P><SPAN LANG="en-us"><FONT SIZE=2 FACE="Arial">The article, “Government in Ignorance of the Law-A Plea for Better Publication of Executive Legislation”, is a fascinating read. In a mere 18 pages, Griswold argues successfully for the need to create a system to publish, in one resource, all of the administrative regulations of a growing nation. Griswold states, “It is clear, therefore, that no search of the statutes (U.S. Statutes at Large, a publication also available in its entirety in</FONT><B></B><B><I> <FONT SIZE=2 FACE="Arial">HeinOnline</FONT></I></B><I></I><FONT SIZE=2 FACE="Arial">) can be complete until the applicable executive pronouncements have been examined. When the legal effect of a statute depends on an administrative ruling, the order bringing the statute to life or tolling its existence should be as readily available as the statute itself.” (48 Harv. L. <P><SPAN LANG="en-us"><FONT SIZE=2 FACE="Arial">As a result, Congress enacted legislation to create the Federal Register (See</FONT><B></B><B><I> <FONT SIZE=2 FACE="Arial">HeinOnline</FONT></I></B><I></I><FONT SIZE=2 FACE="Arial">’s U.S. Statutes at Large library at 49 Stat. 500 for the Act itself:</FONT><U></U><U><B> <FONT COLOR="#0000FF" SIZE=2 FACE="Arial"><<A HREF="http://heinonline.org/HOL/Page?handle=hein.statute/sal049&collection=statute&id=548">http://heinonline.org/HOL/Page?handle=hein.statute/sal049&collection=statute&id=548</A>></FONT></B></U><B></B><FONT SIZE=2 FACE="Arial">).</FONT></SPAN></P>
<P><SPAN LANG="en-us"><FONT SIZE=2 FACE="Arial">When you have an opportunity (perhaps on your flight to St. Louis for this year’s AALL annual meeting!), I encourage you to read Griswold’s article; a truly interesting look at the argument for what was to become an instrumental publication in US Administrative Law.</FONT></SPAN></P>
